Real Estate, Eviction & NYS

The Real Estate Market

NYS Lawmakers are playing judge, jury and executioner when it comes to eviction moratorium. They will pass another extension on eviction moratorium causing harm to landlords and Realtors. However, their solution- let the taxpayer pay the tenants rent.

There are landlords that are owed thousands and thousands and home sellers that cannot close on property because tenants refuse to move and refuse to pay. I am sure there are many cases of tenants whose employment has been affected by the coronavirus epidemic and have hit genuine hardships. I  have seen first hand, that there are people who are taking advantage of a bad situation caused by the epidemic and our state lawmakers. I am happy to share the stories of property owners that are STUCK with property that cannot close due to tenants squatting. I am also available to share incidents of landlords that are unable to collect rent while being abused by tenants that are physically destroying their property.

So what is the solution? First of all this should be looked at region by region. What is going on  in NY city may be different for what is happening in Syracuse, Rochester or Buffalo. The solution- lift the moratorium and let the courts decide. Allow judges to do their job and decide case by case. When the tenant can show employment hardship due to the epidemic give them a break. However the tenant that is squatting without any effort should be moved out. Why should NYS lawmakers decide. Let the courts hear the cases.

This is a property rights issue.  The owner’s right to take possession of their property from a squatter has been taken away. Part of the problem is the tenants have many advocacy  groups and property owners have none. LET THE COURTS DECIDE!
